Appeal a fine for littering from vehicles

How do I appeal?

Only the registered owner of the vehicle can appeal under one of the following categories: 

  • The offence did not occur
  • You bought the vehicle after the offence occurred and have evidence of this
  • You sold the vehicle before the offence occurred and have evidence of this
  • The vehicle was stolen when the offence occurred, and you have evidence of this
  • You are a hire company and the vehicle was on hire at the time of the offence
  • You were not the keeper of the vehicle for another reason
  • The local authority was not authorised to issue the fine
  • Your vehicle is a hackney carriage or public service vehicle and the offence was committed by a passenger
  • You or another person has already been issued with a Fixed Penalty Notice or been prosecuted for the criminal offence of littering
  • The amount of fine exceeds what is allowed by law
  • The Council has not followed the requirements of the legislation in issuing the fine
  • Any other reason

Stage 1

You should:

We will review your case. If the appeal is successful, we will cancel the fine and, depending on how you appealed, confirm via email or letter.

If your appeal is rejected, we will send a 'Notice of Rejection' explaining the reasons why and what you can do next. 

Stage 2

If you are unhappy with our response, we will send you a Notice of Rejection letter. You can then appeal online to the Traffic Penalty Tribunal (TPT).

The TPT is an independent organisation. A lawyer will examine your case, and any decisoin that is made is final and binding on both sides. 

Stage 3 - Enforcement Notice

If at the end of the 28 days you have not paid or appealed a fine, we will issue an Enforcement Notice and increase the penalty.
