Summary
Structures such as a canopy or balcony of a building, which oversail the highway on a permanent basis must be licensed. Structures that also extend under the highway such as basements also need to be licensed.
Only apply for a projecting over/under the highway permit from us if the location fails within Manchester City Council check which council.

Fees

The fee is a one off charge for the issue of a permit, if a licensed structure is renewed or replaced a new permit is required.
Once your application has been made, this is then referred to our legal department for processing which may take up to six weeks and incur additional fees / costs.

Application and guidance notes
In order that we can agree and process a Projection Over / under Agreement and the subsequent license, we require the following information to be detailed upon the plans:
- All Street / road names relative to the projections to be shown.
- The actual buildings need to be clearly identified for record purposes.
- A north point to be shown on the footprint plan.
- The developers and license applicants details to be shown.
- All footway lines front and back edge to be shown and indicated upon the plan.
- A legend to the plan
- All widths and depths of the intended projection over to be shown. A clear indication of the maximum widths and minimum heights of each projection.
- The projection over / under to be indicated in a coloured outline. Where the projection over may be part building / part canopy, then different coloured outlines to be used.
- A colour key code to be included.
- The plans need to be to scale with the scale shown.
- 3 copies of the footprint plan and 3 copies of each elevation plan related to the projection over to be submitted.

Attachments required
Plans and drawings as follows:

Detailed scaled plans of the proposed structure;

Elevation plans;

Copy of an Ordnance Survey Site Plan; and

Copy of detailed scaled plans (1:1250 or 1:500 preferable) showing the exact location and dimension of the proposed area of highway affected, and indicating any private forecourt. The building line must be shown, the width of the footway and the centreline of the carriageway (if applicable) together with any fixed highway furniture, e.g. lamp posts, railings, planter, manholes/inspection chambers etc; and

Pre - site photographs.
Proof that the works are permitted development, namely:

The decision letter or an appeal inspector’s notice in response to an application/appeal under the Town and Country Planning Act 1990 for permission to develop; and

A plan listed in that letter or notice which shows the proposed oversail.
